The dismissal, issued on March 11, 2026, by U.S. District Judge Nina Gershon, found that the plaintiffs’ complaint lacked sufficient grounds to establish an actionable claim. Specifically, the court ruled that the lawsuit did not provide adequate evidence to support the conspiracy claims or any association between the defendants.
The case, Roosevelt Road Re, Ltd. v. John Haggar, M.D., et al., involved accusations that Gorayeb & Associates and the physicians involved in the case had conspired to defraud injured workers. However, the court determined that the complaint failed on three critical points: lack of proximate causation, insufficient evidence to establish a conspiracy, and failure to prove an illegal agreement between the parties.
In its ruling, the court emphasized that referral agreements between medical professionals and attorneys, which allow injured workers to receive necessary care, are not, by nature, conspiratorial. These agreements are standard practice in many industries, such as banking and healthcare, and do not constitute fraudulent activity.
