Gorayeb & Associates, P.C., one of New York’s most prominent construction accident law firms, announced that the United States District Court for the Eastern District of New York has dismissed the federal complaint filed against the firm and doctors
The dismissal, issued March 11, 2026 by U.S. District Judge Nina Gershon, found that the plaintiffs’ complaint was deficient on three independent grounds.
The lawsuit, Roosevelt Road Re, Ltd. v. John Haggar, M.D., et al., Case No. 24-CV-1549, attempted to silence injured workers along with their attorneys and their treating physicians for injuries they sustained on unsafe job sites.
In a far-ranging decision, the Court held that the complaint did not allege any facts establishing an association-in-fact enterprise or conspiracy.
Highlighting the decision, the court agreed with the defendants that there were “three fundamental deficiencies in the [complaint’s] … conspiracy claims: 1) the lack of allegations establishing proximate causation… 2) the failure to allege facts to establish an association-in-fact enterprise; and 3) the failure to allege facts from which one can infer that Defendants agreed to engage in conduct constituting a… violation.”
The decision further stated that standard referral agreements between professionals do not constitute a “conspiracy.” Referral agreements allow attorneys to refer their clients to doctors so that injured workers may receive the treatment they need. The referrals are no different than that of a banker referring a client to an accountant, or a primary physician referring a patient to a radiologist.
The decision constitutes a rebuke of insurance companies that work to deny payments to injured workers.
